Terms of use

RH IQ is created and supplied by Matt Laframboise, in Ontario, Canada. Contact: matt@theraspberry.ca. No company is registered for this business yet; when one is, these terms will name it.

A licence to use RH IQ within your organisation for training your own people, for as long as your access lasts. You may install it on as many of your own machines as you need, and use its printable outputs internally.

You may not resell it, sublicense it, publish its curriculum, or use it to build a competing training product. The curriculum, the software and the wording throughout remain the author’s.

RH IQ is training material. It is not legal advice, clinical advice, or a professional opinion on any matter before you. It does not create a solicitor-client or clinician-patient relationship and it does not replace your counsel, your medical director, your regulator or your own judgement.

It teaches the Retirement Homes Act, 2010, O. Reg. 166/11, and the practice around them. Legislation is amended and guidance is reissued. A module is accurate as at its authoring date, which the product records; it is not a live feed of the law. When a real decision turns on a statutory specific, read the current source or take advice.

Curriculum content is undergoing subject-matter review. Where that review is incomplete the product says so rather than implying a confidence it has not earned.

Everything RH IQ records stays in the browser it was created in. We hold no copy and cannot obtain one. That means your records are yours to keep and yours to lose: clearing site data destroys them, and this build has no backup or restore feature.

You are responsible for what you enter. Two tools deliberately capture identifying information about people other than the user — see the privacy page, section 7 — and any obligations attaching to that information are yours as the residence, not ours.

RH IQ is a folder of static files. Once you have it, it runs whether or not this website is up, and whether or not your network has an internet connection. We make no uptime commitment about this website, and none is needed for the product to keep working.

Completing the curriculum issues a certificate carrying an authorization code. That code is derived from the recipient’s name and the completion date, so it can be re-checked later. Three questions get asked of such a code, and they have different answers:

• Was it typed correctly, and does it match this name and date? Settled. The verifier answers that, and it will tell you when a code belongs to a sibling product rather than to RH IQ.
• Has the name or date been altered since issue? Settled. Change either and the code stops matching.
• Did RH IQ issue it? Not established, and it cannot be until there is a server-side registry to ask. The code is tamper-evidence, not proof of issuance. Why that follows from the way the product works is set out on the home page.

RH IQ is not an accredited body and its certificate is not a licence, a designation, or a regulatory qualification. It evidences completion of this program and nothing more. The RHRA grants no standing on the basis of it.

RH IQ is supplied as it is, without warranty of any kind — express or implied — including fitness for a particular purpose. We do not warrant that it is free of error or that its content is complete or current.

To the extent the law allows, our total liability arising out of RH IQ is limited to what you paid for it in the twelve months before the claim. We are not liable for indirect or consequential loss, for lost records, or for a decision taken in reliance on training material rather than on advice.

Nothing here excludes liability that cannot lawfully be excluded.

These terms may change; changes are dated at the top. A material change will be described rather than folded in quietly. Continuing to use RH IQ after a change means accepting it.

These terms are governed by the laws of the Province of Ontario and the laws of Canada applicable there, and the courts of Ontario have jurisdiction.
